Terms of Service
Last updated: October 4, 2026
These Terms of Service ("Terms") govern your use of BitList. BitList is operated by Brocan LLC ("BitList," "we," "us," or "our").
By creating an account or using BitList, you agree to these Terms. Our Privacy Policy separately explains how we collect, use, and protect personal information.
We've tried to keep these Terms clear and readable. If you have questions, contact us at hello@bitlist.app.
1. Your account
When you create a BitList account:
- Keep your account secure. You're responsible for protecting your login credentials.
- You're responsible for activity under your account. This includes content created, shared, or published through your account.
- Don't abuse accounts through automation. You may not create or operate accounts using unauthorized bots or automated systems.
- You must be at least 13 years old, or the minimum age required to consent to data processing in your country if that is higher. If you're under the age of legal majority where you live, you may use BitList only with permission from a parent or legal guardian.
You may sign in using third-party authentication services such as Google or Apple. Those services are subject to their own terms and availability.
You can delete your BitList account from your account settings.
2. Your content belongs to you
Your lists, notes, images, files, and other content remain yours. We don't claim ownership of your content.
You give BitList a limited, non-exclusive, worldwide, royalty-free license to store, process, copy, format, and display your content only as necessary to operate, maintain, secure, and provide BitList and the features you choose to use.
You are responsible for making sure you have the rights necessary to upload, share, collaborate on, or publish your content.
3. Sharing and collaboration
BitList lets you share lists and collaborate with other people.
If you create a share link, anyone with access to that link may be able to view the content and share the link with others. You're responsible for what you make available through shared links.
People you invite to collaborate may be able to add, edit, or remove content depending on their permissions. That means content in a shared list may be changed or deleted by other authorized collaborators.
BitList can't remove copies that someone has independently downloaded, copied, screenshotted, or saved outside the service.
4. Publishing to Explore
You can choose to publish lists to Explore.
When you publish a list, you make that list public and authorize BitList to display, format, distribute, and promote it within the service. This may include its title, description, icon, previews, and your preferred profile name and profile photo, if set.
We don't use your account email address as Explore attribution unless you choose to make it public yourself.
We may organize, rank, recommend, feature, restrict, or remove content from Explore. Publishing doesn't guarantee visibility, ranking, traffic, engagement, or placement.
You can unpublish a list at any time.
Public content may already have been shared, indexed, copied, or cached by third parties. We can't remove copies outside BitList's control, and temporary backups or caches may remain for a limited period.
5. Acceptable use
Use BitList responsibly.
Don't use BitList to:
- break the law or violate someone else's rights;
- upload malware, malicious code, or harmful files;
- harass, threaten, impersonate, defraud, or deceive people;
- unlawfully expose someone's private information;
- send spam or abuse sharing or collaboration features;
- scrape, crawl, harvest, or access BitList through unauthorized automated systems;
- bypass security, plan limits, or access restrictions;
- intentionally disrupt, overload, probe, or gain unauthorized access to BitList or its systems.
We may remove content, limit features, suspend accounts, or terminate accounts when reasonably necessary to enforce these Terms, comply with law, protect users or third parties, or protect the security and integrity of BitList.
We may also use automated tools and service providers to help detect content that violates these Terms, for example by scanning uploaded images. If you believe something was removed in error, contact hello@bitlist.app.
6. Copyright and intellectual property
BitList's software, design, branding, logos, and other service materials belong to BitList or its licensors. Using BitList doesn't give you ownership of our software, branding, or other intellectual property.
Don't upload or publish content that infringes someone else's copyright, trademark, or other rights.
If you believe content on BitList infringes your rights, contact hello@bitlist.app with enough information for us to review the claim.
We may remove allegedly infringing content and suspend or terminate repeat infringers where appropriate. Copyright complaints may also be subject to additional procedures we publish as required by applicable law.
7. Free and paid plans
BitList may offer Free, Pro, or other plans.
Plans may have different features, item limits, media storage limits, file-size limits, or other usage limits. Current details and pricing are shown in BitList before you subscribe.
If you move to a plan with lower limits, we won't delete existing content solely because you're above the new limit. However, some actions, such as adding new items or uploading new files, may be restricted until your usage is within your current plan's limits or you upgrade again.
When we describe something as unlimited, we mean there is no ordinary fixed limit for normal use. Unlimited features remain subject to reasonable technical, security, performance, and anti-abuse restrictions.
8. Subscriptions and billing
Paid subscriptions renew automatically for the billing period selected at purchase unless you cancel before renewal. By starting a paid subscription, you authorize recurring charges at the price and billing interval shown at checkout until you cancel.
You can cancel at any time through the subscription controls available in BitList or, if you subscribed through an app marketplace, through that marketplace's subscription settings.
Cancelling stops future renewals. Your paid features normally remain active until the end of the billing period you've already paid for.
Payments are processed through our payment provider or through the app marketplace where you subscribed. Subscriptions purchased through an app marketplace are also subject to that marketplace's billing, cancellation, and refund rules.
Deleting your BitList account does not automatically cancel a subscription billed by an app marketplace. You must manage that subscription through the applicable marketplace.
If a payment fails, is reversed, or can't be collected, we may suspend paid features or move your account to the Free plan after any applicable grace period.
Taxes may be added where required by law.
9. Refunds
Payments are generally non-refundable except where required by law or by the payment provider or app marketplace that processed the purchase.
If you live in the European Union or the United Kingdom, you have a 14-day right to withdraw from a purchase. By starting a subscription you ask us to provide the paid features immediately and acknowledge that, once they are provided, the right to withdraw no longer applies for that billing period.
If something went wrong with a BitList purchase, contact us at hello@bitlist.app and we'll review the situation.
10. Promotional and locked pricing
From time to time, BitList may offer promotional or locked pricing.
If your subscription includes locked pricing, the qualifying price remains available while that subscription stays continuously active. Cancelling, allowing the subscription to expire, or switching plans may end eligibility for that pricing.
Locked pricing applies to the subscription price. It doesn't guarantee that every feature, storage limit, or plan benefit will remain unchanged forever.
11. Changes to BitList
We're continually improving BitList. We may add new features, change existing features, adjust plan limits, or remove features that are no longer practical to maintain.
We'll try to communicate significant changes when appropriate, but we can't promise advance notice for every product change.
If a change materially reduces a paid service during a prepaid billing period, we'll provide reasonable notice and any remedy required by applicable law.
We may also discontinue part or all of BitList. If the entire service is shutting down, we'll provide reasonable advance notice so you can save or copy your content before it becomes unavailable.
12. Availability, warranties, and data
We work to keep BitList reliable, but software and online services sometimes fail. BitList is provided "as is" and "as available."
To the maximum extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We don't guarantee that BitList will always be available, uninterrupted, secure, error-free, or free from data loss. You should keep copies of content that is especially important to you.
We aren't responsible for delays or failures caused by events outside our reasonable control.
Nothing in this section limits any warranty, right, or remedy that New Jersey law or other mandatory law applicable to you does not permit us to limit or disclaim.
13. Account suspension, termination, and deletion
You can stop using BitList or delete your account at any time.
We may restrict, suspend, or terminate an account, disable sharing, remove content, or unpublish Explore content when reasonably necessary to:
- enforce these Terms;
- comply with law or legal requests;
- respond to infringement claims;
- protect users or third parties;
- prevent fraud or abuse; or
- protect the security and operation of BitList.
We'll try to act proportionately, but serious violations may require immediate action.
When you delete your account, we remove your account and associated content as required by applicable law and platform requirements. Some information may remain temporarily in backups or be retained where reasonably necessary for security, fraud prevention, dispute resolution, or legal obligations.
Deleting your account can't remove copies that other people or third parties independently saved outside BitList.
14. Third-party services
BitList may rely on third-party services for functions such as authentication, hosting, storage, content moderation, bot protection, payments, and app distribution. Those services may be subject to their own terms and may experience outages, changes, or interruptions outside BitList's reasonable control.
15. Liability
To the maximum extent permitted by law, BitList and its owners, employees, affiliates, and service providers won't be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost data, profits, revenue, business interruption, or business opportunities.
To the maximum extent permitted by law, our total liability arising out of or relating to BitList will not exceed the greater of:
- $100, or
- the amount you paid BitList during the 12 months before the claim arose.
Nothing in this section limits any liability, right, or remedy that New Jersey law or other mandatory law applicable to you does not permit us to limit.
16. Your responsibility for third-party claims
To the extent permitted by law, you agree to indemnify and hold BitList and its affiliates, owners, employees, and service providers harmless from third-party claims and reasonable costs arising from:
- content you upload or publish that infringes another person's rights; or
- your intentional unlawful misuse of BitList.
This section applies only to the extent permitted by applicable law.
17. Changes to these Terms
We may update these Terms as BitList evolves.
If we make significant changes, we'll provide reasonable notice through BitList, by email, or through another appropriate method where required.
If you continue using BitList after updated Terms take effect, you agree to the updated Terms. If you don't agree with the updated Terms, you should stop using BitList before they take effect.
18. General
These Terms form the agreement between you and BitList regarding your use of the service.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. If we don't enforce a provision immediately, that doesn't mean we're giving up our right to enforce it later.
We may transfer these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or transfer of the BitList business. You may not transfer your rights or obligations under these Terms without our consent.
19. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
To the extent permitted by law, disputes that can't be resolved informally will be handled by the state or federal courts located in New Jersey, and you and BitList consent to their jurisdiction.
Nothing in these Terms removes or limits any consumer right that New Jersey law or other mandatory law applicable to you does not permit you to waive.
